This is a long-awaited event in the reform process of the Estonian top-level domains, as a result of which all .ee domains will be more freely available and the domain administration in Estonia will be based to the same grounds as in the European Union and the rest of the world. 2010.07.12 Amendments to the Public Procurement Act 2010-2011 On 1st July 2010, a package of amendments to the Public Procurement Act entered into force, the objective of which was to make the arrangement of procurement procedure more effective and to regulate any obstacles arising from extensive disputes in adopting structural aid. The transposition of the EU Remedies Directive 2007/66/EC was the primary basis for amending the provisions related to the procurement procedure. In the following, we will outline the more important amendments, the majority of which entered into force on 1st July 2010 with a specific part entering into force on 1st January 2011. 2010.07.05 Triin Tuulik admitted to PhD Triin Tuulik was admitted to state financed PhD studies in the University of Tartu, faculty of law. The litigation and arbitration department of Glimstedt headed by partner Marko Tiiman successfully represented the insurer. 2007.11.16 Glimstedt successfully represented a client in tax dispute The Estonian Supreme Court’s judgement of the 13th November 2007 is significant in interpreting the concept of a holder in the context of the Surplus Stock Charges Act and EU law. The pan-Baltic transaction also involved the purchase by OÜ Pisipehme of the shares of Shell Eesti AS, Shell SIA and Shell Lietuva UAB. Glimstedt's offices in Riga, Tallinn and Vilnius advised the Shell Group on this transaction. 2007.06.19 Glimstedt Straus & Partners successfully represented client in a tax interest refund dispute In its judgment of 13th June 2007 (AS Tallinnfilm vs Northern Tax and Customs Centre of the Estonian Tax and Customs Board) the Supreme Court of Estonia resolved the question whether a taxable person has a right to file a claim for refund in case he was not filed a claim for interest after 5th November 2002, but he paid interests voluntarily, including based on decision of paying tax arrears in instalments. It should also be noted that the security regulation ensuring an action in the new Code of Civil Procedure causes confusion. 2005.12.27 Precedent: source of information may be a person who forwards information to the press and this person may be liable for the forwarded information December 21, 2005 the Supreme Court of Estonia made an important judgment in the field of media law (civil case no 3-2-1-95-05; Merck Sharp & Dohme Inc vs Pfizer H.C.P. Corporation). The legal question in the present case was if in the meaning of the Law of Obligations Act § 1047 the disclosure of incorrect information would only mean disclosure to the general public via a media publication or does it also mean the disclosure of incorrect information to media companies. We are looking forward to meeting you at our new office. 2005.07.04 Provisional legal protection in telecom disputes On the 7th of June the Circuit Court of Tallinn refused a request of Elion Enterprises Ltd (hereinafter Elion) to suspend the compliance with the precepts of the Estonian National Communications Board. The court found that in given matters the Elion’s interest to suspend the compliance with the precepts didn’t outweigh the public interest and interest of competitors for the immediate compliance with the precepts. 2005.06.15 The liability of the carrier of merchant shipping On the 10th of June 2005 Civil Chamber of the Supreme Court has made a decision in the case AS Sanwood vs AS Eesti Mereagentuur, where the Supreme Court treated the liability of the carrier of merchant shipping for the first time in its practice. The Supreme Court satisfied an appeal in cassation made by Straus & Partners Law Firm, who represented AS Eesti Mereagentuur in this case. 2005.05.20 Parliament amends legal norm that groundlessly stymied real estate developers Real estate developers have repeatedly expressed their objections to a principle deriving from Subsection 26 (3) of the Planning Act, according to which any objections to planning decisions meant an automatic halt to all proceedings related to a given plan and bar on the issuing of administrative acts by administrative bodies. As a result of the principle, planning proceedings that already lasted years were extended by an inordinate and indefinite period of time without the particulars of each case being considered. In practice, this situation was exploited by malicious litigants whose only desire was to bring the real estate development process to a halt for years in order to extort money. 2005.05.20 Another precedent handed down by the Supreme Court in copyright issues On 6 May 2005, the plenary session of the criminal chamber of the Supreme Court issued a long-awaited decision regarding copyright law.
